1. USER INFORMATION

Who is responsible for processing your personal data?

BRISA CAMUR SL is the DATA CONTROLLER of the USER’s personal data and informs them that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR), and Organic Law 3/2018 of December 5 (LOPDGDD).

For what purposes do we process your personal data?

To maintain a commercial relationship with the user. The operations planned for processing are:

  • Sending commercial advertising communications by email, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that enables commercial communications. These communications will be made by the CONTROLLER and will be related to their products and services, or those of their collaborators or suppliers with whom they have reached a promotion agreement. In this case, third parties will never have access to personal data.

  • Conducting market research and statistical analysis.

  • Processing orders, requests, responding to inquiries, or any type of request made by the USER through any of the contact forms available on the CONTROLLER’s website.

  • Sending the online newsletter about news, offers, and promotions in our activity.

On what legal basis can we process your personal data?

The processing is legitimized by Article 6 of the GDPR as follows:

  • With the USER’s consent: sending commercial communications and the newsletter.

  • By legitimate interest of the CONTROLLER: conducting market research, statistical analysis, etc., and processing orders, requests, etc., at the USER’s request.

How long will we keep your personal data?

They will be kept no longer than necessary to maintain the purpose of the processing or until legal prescriptions require their retention. When no longer necessary, they will be deleted with appropriate security measures to ensure data anonymization or total destruction.

To whom do we disclose your personal data?

No personal data communication to third parties is planned, except if necessary for the development and execution of the processing purposes, to our communication service providers, with whom the CONTROLLER has confidentiality and data processing agreements as required by current privacy regulations.

What are your rights?

The USER’s rights are:

  • The right to withdraw consent at any time.

  • The right to access, rectify, port, and delete their data, and to limit or oppose its processing.

  • The right to file a complaint with the supervisory authority (www.aepd.es) if they consider the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

USERS, by ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or in download forms, expressly and freely accept that their data are necessary to process their request by the service provider, while inclusion of data in the other fields is voluntary. The USER guarantees that the personal data provided to the CONTROLLER are truthful and commits to inform of any changes.

The CONTROLLER informs that all data requested through the website are mandatory as they are necessary to provide an optimal service to the USER. If all data are not provided, it cannot be guaranteed that the information and services offered fully meet their needs.

3. SECURITY MEASURES

In accordance with the provisions of current data protection regulations, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD for processing the personal data under its responsibility, and clearly with the principles described in Article 5 of the GDPR, by which data are processed lawfully, fairly, and transparently in relation to the data subject, and are adequate, relevant, and limited to what is necessary for the purposes for which they are processed.

The CONTROLLER guarantees having implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and LOPDGDD in order to protect the rights and freedoms of USERS and has provided them with adequate information to exercise them.
